Welcome to JobMatchPro. These Terms of Service ("Terms") govern your access to and use of the JobMatchPro website, applications, and services (collectively, the "Service") operated by Appecho Labs LLC ("Company," "we," "us," or "our").

1. Eligibility

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete, or if we believe you have violated these Terms.

3. Description of Service

JobMatchPro is a software-as-a-service (SaaS) platform that provides tools for creating federal resumes intended for use with USAJOBS and other federal job application systems. The Service includes:

• Resume building and editing tools
• AI-powered compliance auditing to help identify potential issues with your resume
• Resume export in PDF format
• Cloud storage for your resume data

3.1 No Guarantee of Employment

THE SERVICE IS A TOOL TO ASSIST YOU IN CREATING RESUMES. WE DO NOT GUARANTEE THAT USING THE SERVICE WILL RESULT IN EMPLOYMENT, INTERVIEWS, OR ANY SPECIFIC OUTCOME IN YOUR JOB SEARCH. Success in federal hiring depends on many factors outside our control, including but not limited to your qualifications, the specific job requirements, and agency hiring decisions.

3.2 Not Legal or Career Advice

The Service, including any AI-generated suggestions or compliance audits, does not constitute legal, employment, or career advice. We recommend consulting with qualified professionals for specific guidance regarding your job applications.

3.3 No Government Affiliation

JobMatchPro and Appecho Labs LLC are not affiliated with, endorsed by, or connected to the U.S. Office of Personnel Management (OPM), USAJOBS, or any federal government agency. Any references to OPM requirements or federal hiring practices are for informational purposes only.

4. Fees and Payment

4.1 Pricing

Some features of the Service require payment. Current pricing is displayed on our website and may be changed at any time with notice. All prices are in U.S. dollars unless otherwise stated.

4.2 Payment Processing

Payments are processed by Stripe, Inc. ("Stripe"), our third-party payment processor. By making a purchase, you agree to Stripe's terms of service. We do not store your complete payment card information on our servers.

4.3 Subscriptions

If you purchase a subscription:

• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
• You authorize us to charge your payment method on file for the renewal
• You may cancel your subscription at any time through your account settings
• Cancellation will be effective at the end of your current billing period

4.4 Refund Policy

We offer a 30-day money-back guarantee on all purchases. If you are not satisfied with your purchase, you may request a full refund within 30 days of the original purchase date by contacting support@jobsmatchpro.com. Refunds will be processed to the original payment method within 5-10 business days.

4.5 Taxes

You are responsible for any applicable taxes. We will collect and remit sales tax where required by law.

5. User Content

5.1 Your Content

You retain ownership of all content you submit to the Service, including resume data, employment history, and other personal information ("User Content"). By submitting User Content, you grant us a limited license to use, store, and process your content solely to provide the Service to you.

5.2 Content Accuracy

You are solely responsible for the accuracy, completeness, and legality of your User Content. You represent and warrant that your User Content does not:

• Contain false or misleading information
• Infringe on any third party's intellectual property rights
• Violate any applicable law or regulation
• Contain fraudulent information intended to deceive employers

5.3 AI Processing

By using our AI-powered features, you consent to your User Content being processed by our AI systems and third-party AI providers (including OpenAI) for the purpose of providing compliance auditing and suggestions. We do not use your User Content to train AI models.

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable federal, state, local, or international law or regulation
• Create fraudulent resumes or misrepresent your qualifications
• Impersonate any person or entity or falsely state your affiliation
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or any other systems or networks
• Use any automated system, including "robots," "spiders," or "scrapers" to access the Service
• Introduce any viruses, malware, or other harmful code
• Resell, redistribute, or sublicense the Service without our written permission
• Remove, alter, or obscure any proprietary notices from the Service

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Appecho Labs LLC and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

7.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include the right to:

• Modify or copy the Service or any part thereof
• Use the Service for any commercial purpose without our written consent
• Reverse engineer or attempt to extract the source code
• Transfer your license to any third party

7.3 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation to you.

You agree to defend, indemnify, and hold harmless Appecho Labs LLC and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User Content
• Your use of the Service
• Your violation of any rights of a third party
• Any claim that your User Content caused damage to a third party

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at support@jobmatchpro.com or through your account settings. Upon termination, your right to use the Service will immediately cease.

11.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

11.3 Effect of Termination

Upon termination, we may delete your account and all associated data. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting us at support@jobsmatchpro.com. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, either party may proceed to formal dispute resolution.

12.3 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Alexandria, Virginia, or at another mutually agreed location.

YOU AND APPECHO LABS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

13.2 Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

13.4 Notices

We may provide notices to you by email, posting on the Service, or other reasonable means. You may provide notice to us at the contact information below.

13.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice through the Service or by sending you an email at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
